I beat Whole Property Management (WPM) in Small Claims Court without being able to personally notify them and here is why/how:
They were my PM company and when I was diagnosed with GBM Cancer, I decided I would sell my house after my lease was up. I asked WPM to notify the tenant so they would have time to find a property prior to the end of the lease. WPM let the tenant out of the property early and without my permission and dropped me as a client so I dealt with a very disturbed house on my own after the tenant left. This broke the lease dates and the management agreement I had with WPM. WPM would not discuss any of this with me so Small Claims Court was my only option. To notify WPM of the court issues, I tried the following without any response from WPM:
- EMAILS (from myself, one from a lawyer, two from a mediator, one from the court, etc)
- Certified mail (one from myself and one from a document server)
- Sheriff attempted to notify them different ways 6 times (at their office, voice mails, etc)
- Document server attempted to serve, wrote proper documentation
- My buddy attempted to talk to a property manager, which WPM doesn't do anymore
I documented all of my attempts and created three copies to bring to court in an organized way. WPM claimed they were not notified but I could prove that everything went to the addresses listed at the Colorado Secretary of State page where WPM legally must respond to. I videoed myself mailing them any court papers with the Colorado SOS addresses next to the envelope and emailed them the court papers and exhibits with the court attached. It is possible to win, stay organized and give the judge a binder of information proving that you tried your best to contact WPM.
